Terms of Use

1. Scope of application

Use of these internet pages (hereinafter referred to as: "the Krones website"), as offered by Krones AG and/or its subsidiaries ("Krones"), shall be permitted only subject to these conditions. In individual cases, these general Terms of Use may be augmented, amended or replaced by further provisions, e.g. for the obtaining of products and/or services. The validity of the particular version of these terms of use shall be regarded as having been accepted upon log-in, or, if a separate log-in should not be necessary, upon commencement of use.

A user viewing web offers that address companies or public corporations represents his respective company or public corporation. The user´s action and knowledge shall be imputed to the company or public corporation.

2. Services

On the Krones website, Krones shall make available certain information for the purposes of accessing or down-loading. Krones accepts no responsibility for the topicality, correctness, completeness or quality of the information provided.

Liability claims against Krones which refer to material or idealistic damage caused by the use or non-use of the offered information or the use of inaccurate and incomplete information shall always be excluded in so far as Krones cannot be proven to have acted intentionally or with gross negligence.

All offers on the Krones website are subject to change and are without obligation. Krones observes the right to alter, expand or delete parts of the sites or the entire Krones website without extra notification or to stop publication temporarily or completely. Due to the nature of the internet and of computer systems, Krones accepts no liability for the uninterrupted availability of the Krones website.

3. Intellectual property

The data belonging to this Krones website, their information, brand names and other contents or any results which have been generated or displayed using the presentation tools, either as a whole or in part, may only be viewed, copied and/or saved for private, non-commercial use. Their use is limited to the acquisition of information regarding the goods and services offered.

The contents or results of the data of the Krones website shall not be transferred, used, sold, leased, exploited, reproduced, expanded, altered or circulated for anything other than private purposes (see above) without prior written approval from Krones AG.

The copyright for published objects created by Krones themselves (graphics, sound documents, video sequences and texts, etc.) remains with Krones only. The processing or alteration, reproduction or use of such objects in other electronic or printed publications is not permitted without Krones´ prior written approval. Copyright instructions and brand designations may not be altered nor omitted.

All brands and trademarks mentioned in this Krones website, and which may be protected by third parties, are subject without restriction to the regulations of the valid registration laws and possessive rights of the respective owner. A simple mention does not mean that trademarks are not protected by third-party rights.

Over and above the usage rights or other rights expressly granted, the user shall be granted no further rights of any kind, in particular to the company names and commercial property rights, such as patents, utility patterns or brands, nor shall Krones be subject to any corresponding obligation to grant such rights.

The information on the Krones website are protected by copyright law, by international copyright agreements, as well as by other laws and agreements about intellectual property. The user shall observe these laws and not remove particularly the alphanumeric identifiers, brands and copyright annotations from the information. Articles 69a and foll. of the copyright law remain unaffected.

Ideas and suggestions posted in the website by a user may be used by Krones free of charge for development, improvement and distribution of the products from the Krones portfolio.

4. Registration, password

Some pages of the Krones website may be password-protected. In the interests of the security of business transactions, access to these pages is only available to registered users. Users shall enjoy no automatic right of registration by Krones. In particular, Krones reserves the right to make web pages, including those previously freely accessible, subject to an obligation to register. Krones shall be entitled at any time to revoke access authorization by barring the access data, without being required to state their reasons for taking such action, particularly if the user

• has provided false details when registering,
• has breached these provisions or his duty of care in dealing with the access data,
• has violated applicable law during access or use of the Krones website, or
• has not made use of the Krones website for an extended period.

If registration is provided for, the user shall be obliged to provide truthful registration details and to notify Krones without delay in the event of any subsequent change to these details (where possible, online). The user shall ensure that he receives the e-mails sent to the e-mail address he has specified.

After registration has been completed, the user is issued a user ID and password (hereinafter referred to as "user data").

The user shall ensure that the user data is not made available to third parties, and shall be liable for all orders and activities carried out under this user data. After each session of use, the user shall leave the password-protected area. Should the user become aware that third parties are misusing the user data, they are obligated to inform Krones of this fact in writing and without delay. Notice can be given in advance by means of a simple e-mail, if applicable.

After receipt of the notification, Krones shall block access to the password-protected area with this user data. The block may only be lifted after Krones has received a written application to this effect from the user, or after re-registration.

The user can at any time submit a written request for the cancellation of his registration, insofar as such a cancellation does not preclude the conducting of current contractual relationships. In this case Krones shall delete all user data and all other stored data of a personal nature belonging to the user, as soon as this data is no longer required.

5. References and links

The Krones website may contain hyperlinks to web pages belonging to third parties. Krones neither accepts any responsibility for the contents of these web pages nor does Krones adopt these web pages and their contents as its own, since Krones does not exercise any control over the linked information and bears no responsibility for the content and information contained therein. This information is thus utilized entirely at the user’s own risk. (Note: see clause 2.)

6. Duties of the user

In utilizing the Krones website, the user shall not:

• harm any persons, or infringe their personal rights;
• offend against morality with his conduct;
• breach industrial property rights and copyright, or other rights of ownership;
• transmit contents containing viruses, Trojans or other programmed elements capable of damaging software;
• enter, store or send hyperlinks or contents for which he has no authorization, in particular when these hyperlinks or contents breach confidentiality obligations or are contrary to the law; or
• distribute advertising material or unsolicited e-mails (so-called "Spam") or unfounded warnings against viruses, malfunctions and the like, or participate in gaming, snowball systems, chain letters or pyramid schemes, or solicit similar campaigns.

Krones shall be entitled at any time to bar access to the Krones website, particularly if the user breaches his obligations in relation to these provisions.

7. Exclusion of liability

Insofar as information is made available free of charge, any liability in respect of warranty of title and quality of information, in particular in relation to its correctness, freedom from defect, freedom from third-party industrial property rights and copyright, completeness and/or practicability – except in the case of intent or malice – shall be excepted.

The information on the Krones website may contain specific or general descriptions of the technical possibilities of products, which need not necessarily apply in particular cases (e.g. as a result of product modifications). The desired performance features of the products are thus to be agreed upon purchase in individual cases.

Although Krones always endeavours to keep the Krones website free of viruses, Krones issues no guarantee as to its freedom from such viruses. Before downloading information, the user shall ensure, for his own protection and to prevent virus infection on the Krones website, that appropriate security mechanisms and virus scanners are in place.
